Getting married in Poland as a foreigner – what to expect?

Do you plan to get married in Poland? That’s great, congratulations! Getting married is really exciting, however,  it unfortunately comes with many formalities, especially for foreigners.

The list of documents you need to provide to the Polish Civil Registry Office before you wedding, is rather long.

However don’t get discouraged. Getting married in Poland as a foreigner – requirements:

If you want to get married, both you and your spouse:

  • must be over 18 years old (there is one exception, an underage woman over 16 can get married, if she obtains family court consent),
  • cannot be curently married,
  • cannot be related,
  • cannot be related by adoption,
  • cannot suffer from a mental illness or mental retardation (although this requirement is treated as partially obsolete and as was confirmed by Polish courts, can be used for annulment of marriage if an affliction poses a threat to this marriage or the health of couple’s children).

To get married in Poland you should meet both – Polish and your country of origin’s – requirements.

Getting married in Poland as a foreigner – what I need to provide?

Maybe you are wondering why there are more formalities, when it comes to marriage in Poland as a foreigner than as a citizen. The reason why it’s the fact that you need to prove, that you have the legal capacity to be married in Poland (that you are not currently in a marriage, you are not under 18, you are not related to your future spouse etc.).

There are two ways, in which you could prove that. First one is to get an official certificate of legal capacity to enter into marriage and the second one involves going to court.

Getting married in Poland as a foreigner – certificate of legal capacity

This is a legal document stating that according to your country of origin you are able to get married. At first glance it may seem like the easier way (because going to an office may seem easier than to court), but in reality it’s often backwords – getting this document may be really hard in some countries and is impossible in other ones. Also Polish Civil Registry Office has standards that theese documents have to meet. The situation that the document you gathered from your home country isn’t suitable for Polish Civil Registery Office isn’t unlikely. In fact there’s a large chance for that happening – how large? Depends on where you are from. To find out whether your country issues such documents you can contact the embassy or consulate of your country of origin operating in Poland.

That’s why in many cases it’s better to go to court.

If you are a US citizen the previous option unfortunately isn’t available for you – USA doesn’t issue this type of documents.

Getting married in Poland as a foreigner – what to do if you can’t get a certificate of legal capacity?

If getting a certificate is difficult or impossible for you, the Polish court can release you from submitting an official certificate of legal capacity.

You will need to initiate the court proceedings and also apply for marriage eligibility for the foreigner.

However you have to be patient. It may take quite a long time (at least half a year).

Which documents I need to gather?

You will need the following documents:

  • valid passport or ID card,
  • a birth certificate or a foreign equivalent of it,
  • the document that will confirm the non-existence of a marriage or both marriage certificate and the document that will confirm the termination or annulment of marriage,
  • certificate of legal capacity to get married or court decision that you are released from submitting an official certificate.
  • It is also advisable to have a document confirming legal residence in Poland.

In addition, a written assurance that there are no obstacles to the marriage (according to Polish law) must be submitted.

Your partner from Poland needs a valid Polish ID card and a birth certificate. If your future spouse was previously married, they will also need a divorce decree.

You need originals of all documents.

Who can translate my documents?

You will need sworn translations of every one of the above-mentioned documents. However you can’t just go to any translator – Polish registry offices (and courts) accept only those made by:

•    a certified translator entered in the register kept by the Polish Minister of Justice,

•    a translator authorised to perform such translations in Member States of the European Union or the European Economic Area (EEA),

•    translations performed by a consul.

No other translations are recognised.

Please note! If one of the future spouses or one of the witnesses does not speak Polish, the presence of a sworn translator is required during the wedding ceremony.
